Use of the ANITO: DEFEND A LAND ENRAGED (the "Product") is subject to the following End-User Agreement. This End-User Agreement constitutes a legal agreement between you and Anino Computer Entertainment Inc. You must accept without modification all the terms and conditions contained in this End-User Agreement in order to fully access the Product.
Purchase of the Product CD from Anino Computer Entertainment, Inc. or any of its authorized dealers and distributors signifies your acceptance of this End-User Agreement, in which case you are hereby bound by the following End-User Agreement as described below.
If the Product is to be accessed online, acceptance of this End-User Agreement requires that you read through this End-User Agreement and click on the "I Accept" button found at the bottom of this statement. By signifying your acceptance, you are hereby bound by the following End-User Agreement.
Pressing the "I decline" button means you decline our offer and do not want to be bound by the following End-User Agreement in which case you will be denied access to the Product.

I. Description of Product
ANITO: Defend A Land Enraged, is a video game for the PC platform. It was designed to run under Microsoft windows 98/ME/2000/ and XP. The minimum requirements are found on the box.
II. Product Cost
a. Anino EntertainmentÆs authorized dealers and distributors shall have the right to fix the retail price of the Product subject to their agreement with Anino Entertainment on the distribution of the Product. Anino Entertainment does not have control and supervision over the manner in which the Product is distributed by said authorized dealers and distributors.
b. If the Product is to be accessed online, the cost of the Product shall be the fee that will be stated upon signifying your acceptance of the following End-User Agreement by clicking the "I Accept" button and providing us with a credit card number. Anino Entertainment reserves the right to fix and change the fee without prior notice. All fees are stated in U.S.Dollars. All fees are prepaid and non-refundable. Upon your acceptance of this End-User Agreement, we will automatically charge your credit card the stated fee plus any applicable taxes we are required to collect, and you authorize us to do so. Thereafter, fees for any updates on the Product shall be subject to separate fees and will not be charged to your account unless you signify your conformity to the terms of said updates.
III. Copyright
Copyright over the contents of the Product is owned solely by Anino Computer Entertainment, Inc. It is protected by the Intellectual Property Code of the Philippines, by the Berne Convention For the Protection Of Literary And Artistic Works and other applicable international treaties and conventions.
Anino Entertainment retains all right, title and interest in the Product including all intellectual property rights embodied therein and derivative works thereof as defined in Sec. 173 of the Intellectual Property Code of the Philippines.
You may not reproduce, duplicate, copy, sell, assign, resell, or exploit for any commercial or other purposes, any portion and use of, or access to the Product, including its accompanying manual or printed materials.
IV. Other restrictions
Purchase of the Product does not include the right to use the included Div X video compression technology for use in real time broadcasting (terrestrial, satellite, cable or other media) or broadcasting via Internet or other networks, such as but not limited to intranets etc. or in pay-video or video-on-demand applications, or for use in computer network gaming.
You will not use this product on more than one computer or terminal at any one time.
You will not reverse-engineer, decompile, disassemble, translate, adapt, modify or otherwise alter the Product in whole or in part nor attempt to do any of the above under any circumstances.
You will not make any further copies in any way whatsoever.
You will not sell, rent, lend, sub-license or otherwise exploit for profit or otherwise this Product in whole or in part.
You will not use the Product or any part of it to develop, design and/or create any programs or other materials based in whole or in part on this Product.
V. Limited Warranty.
Anino Entertainment warrants to the original purchaser of this product that the physical medium on which the software program in this product is recorded will under normal use and conditions be free from material defects in materials and workmanship for a period of ninety (90) days from the date of purchase. The entire liability of Anino Entertainment under the limited warranty set out above will be at its sole option either to repair or to replace, free of charge, the Product provided you return it in its original condition to the point of purchase with a copy of your receipt. Anino Computer Entertainment, Inc. will pay the postage costs of sending a replacement product to you.
If failure of the Product has resulted from accident, abuse, or misapplication, this limited warranty shall not apply. Anino Computer Entertainment, Inc. makes no other warranties to you in connection with this Product, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
Anino Entertainment does not warrant continuous, error-free, secure or virus-free operation of the Product.
VI. Indemnification
You agree to indemnify and hold Anino Computer Entertainment, Inc. its affiliates, officers, employees, and authorized representatives free and harmless from and against any and all claims or demands or proceedings, damages, injuries, liabilities, losses, costs and expenses (including attorneyÆs fees and expenses of litigation) relating to or arising from your unauthorized use of the Product or any breach by you of this End-User Agreement.
Anino Entertainment shall not be liable for any damage to your computer system for loss or damage that may result from your use of the Product or from downloading the Product from the internet.
VII. Confidentiality of Online Information
Information in the internet is not secured. Anino Computer Entertainment, Inc. does not warrant confidentiality of any information that you will furnish when you access the Product or any of its updates online. Anino Entertainment shall not be held liable for any and all damages that you may suffer as a result of unauthorized use of said information by third parties.
VIII. Governing Law
This Agreement shall be governed by, and construed strictly in accordance with, the laws of the Republic of the Philippines. All cases involving this agreement shall be filed with the proper court in Muntinlupa, to the exclusion of all other courts.
